The Jamaica Homes classified property listing portal is owned and operated by JAMAICA HOMES LTD, a company registered in England and Wales under Company No. 17386190.

These Terms apply specifically to the property listing, advertising and related services available through jamaica-homes.com (the “Platform”). They do not apply to other Jamaica Homes websites or services where separate terms are provided.

1. Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms of Use. If you do not agree with these Terms, you should not use the Platform.

Certain services or features may be subject to additional terms displayed when they are used or purchased.

2. About the Platform

The Platform is an independent classified property advertising service that enables advertisers to publish property listings for users to browse and contact advertisers directly.

Listings are submitted by advertisers. Jamaica Homes provides the advertising platform and, unless expressly stated otherwise, does not:

• act as estate agent, realtor, broker or representative for any party;
• introduce or negotiate between buyers, sellers, landlords or tenants;
• independently verify every advertiser or property listing;
• hold deposits, rent, purchase money or other property transaction funds;
• own, manage or control properties advertised by third parties; or
• become a party to any tenancy, sale, purchase or other property transaction.

Advertisers remain responsible for the content of their listings and for their communications and dealings with other users.

3. User Accounts

You may be required to register an account to access certain features, post listings or contact advertisers.

You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account.

Information supplied when registering or using the Platform must be accurate, current and truthful.

You must not impersonate another person, create an account using information you are not authorised to use, or allow your account to be used for fraudulent or unlawful purposes.

4. Advertiser Responsibilities

By submitting or publishing a listing, you confirm that:

• you are authorised to advertise the property;
• all information contained in or supplied with the listing is accurate, complete and not materially misleading;
• the listing complies with the laws and regulations applicable in the country or territory where the property is located;
• you will comply with applicable laws concerning discrimination and the selection of buyers, tenants or lodgers;
• you will not knowingly publish duplicate listings for the same property simultaneously;
• any professional status, qualification, registration, membership or licence you declare is genuine, current and lawfully held;
• you hold any licence, registration, authorisation or permission required to undertake the relevant activity in the jurisdiction concerned; and
• you are responsible for your communications, representations and dealings with other users.

To the extent permitted by applicable law, advertisers are responsible for claims, losses, liabilities, costs and reasonable legal expenses arising from their listings, breach of these Terms, false or misleading declarations, or dealings with another user.

Jamaica Homes does not undertake to write, edit, rewrite or improve advertiser listing copy, including grammar. A listing that does not meet our publishing requirements may be rejected or removed rather than edited on the advertiser's behalf.

5. Prohibited Content and Use

You must not use the Platform to publish, transmit or facilitate content or activity that:

• is fraudulent, materially misleading or deceptive;
• violates applicable law or regulation;
• is unlawfully discriminatory, defamatory, threatening or otherwise unlawful;
• infringes the intellectual property or other legal rights of a third party;
• contains viruses, malware or other harmful code;
• contains bank account details, card details, payment links or payment instructions intended improperly to obtain money from another user;
• impersonates another person, company or organisation;
• uses a property listing primarily to advertise unrelated goods or services;
• attempts to circumvent Platform security or access controls; or
• otherwise materially misuses the Platform.

We may remove content that we reasonably believe breaches these Terms or presents a material risk to users or the Platform.

6. Payments and Fees

Certain advertising, listing and promotional features require payment of a flat fee. Current charges are displayed on the relevant Pricing or checkout page.

Jamaica Homes does not charge commission on property transactions and does not hold deposits, rent, purchase money or other property transaction funds.

Payments for Platform services may be processed through third-party payment providers, including Stripe.

Unless otherwise stated at the time of purchase, advertising fees are non-refundable once the relevant service has been supplied or activated, except where a refund is required by applicable law.

Nothing in these Terms affects statutory rights that cannot lawfully be excluded or restricted.

7. Listing Moderation and Placement

We may reject, suspend or remove a listing where we reasonably believe that it:

• breaches these Terms;
• contains materially inaccurate or misleading information;
• may be fraudulent or unlawful;
• presents a security or safety concern; or
• could materially harm users or the Platform.

We are not obliged to edit or repair advertiser copy before rejecting or removing it.

Listing order may be determined using criteria including recency, price, location, category and paid promotional placement.

A listing identified as Featured, Sponsored or similar means that enhanced placement has been purchased. Unless expressly stated otherwise, paid placement does not constitute a recommendation, verification, endorsement or assessment by Jamaica Homes.

Publication of a listing does not mean that Jamaica Homes has independently verified the advertiser, property, ownership, title, professional status or information contained within the listing.

8. Property Transactions and User Due Diligence

Jamaica Homes provides the Platform through which advertisers and users may connect. Any subsequent communication, negotiation or transaction is between the relevant parties.

Users should carry out appropriate due diligence before paying money, signing documents or entering into any property transaction.

Where appropriate, users should independently verify matters including:

• the identity and authority of the person advertising the property;
• ownership and title;
• professional licences or registrations;
• the physical condition and availability of the property;
• contractual terms; and
• payment instructions.

Users should obtain independent legal, financial, valuation, surveying or other professional advice where appropriate.

9. Limitation of Liability

The Platform is provided on an “as is” and “as available” basis.

While we aim to provide a reliable service, we do not guarantee that the Platform will always be available, uninterrupted, secure or error-free.

Jamaica Homes is not responsible for:

• the accuracy, completeness, legality or suitability of information supplied by third-party advertisers;
• the conduct, identity, financial position, professional status, licence or standing of an advertiser or user;
• the condition, ownership, title, availability or suitability of a property;
• representations made by advertisers or other users;
• third-party websites, services or content linked from the Platform; or
• the outcome of communications, negotiations or transactions between users.

To the maximum extent permitted by applicable law, Jamaica Homes will not be liable for indirect, incidental, special or consequential losses, including loss of profit, business opportunity, data or goodwill arising from use of the Platform.

Where an advertiser has paid Jamaica Homes for a service, our total aggregate liability arising from that paid service will, to the extent permitted by applicable law, not exceed the amount paid by that advertiser to Jamaica Homes for Platform services during the preceding twelve months.

Nothing in these Terms excludes or restricts liability where doing so would be unlawful or excludes rights or remedies that cannot lawfully be excluded.

10. Intellectual Property

Unless otherwise stated, content created by Jamaica Homes and appearing on the Platform, including its branding, graphics, website design, text and other original material, is owned by or licensed to Jamaica Homes and protected by applicable intellectual property laws.

User-generated listings and other material submitted by users remain the responsibility of the person who submitted them.

By submitting photographs, descriptions or other material for publication, you confirm that you have the right to use that material and grant Jamaica Homes a non-exclusive right to host, display, reproduce, format and promote it as reasonably necessary to operate and promote the Platform and the relevant listing.

You may not reproduce, republish, distribute or commercially exploit Jamaica Homes' proprietary content without prior permission except where permitted by law.

11. Account Suspension and Termination

We may suspend, restrict or terminate an account where we reasonably believe that a user has:

• breached these Terms;
• engaged in fraudulent or unlawful activity;
• materially misused the Platform;
• repeatedly submitted misleading or non-compliant listings; or
• created a material risk to other users or Jamaica Homes.

Where appropriate, a suspended user may contact us to request a review.

12. Third-Party Services and Links

The Platform may contain links to or integrate with websites, payment processors and other services operated by third parties.

Jamaica Homes does not control third-party services and is not responsible for their availability, content, security, privacy practices or terms.

Users should review the applicable terms and policies of third-party services before using them.

13. Changes to the Platform

We may add, modify, suspend or withdraw features of the Platform from time to time.

We do not guarantee that any particular feature, listing, account function or service will remain available indefinitely.

Where reasonably practicable, material changes affecting an existing paid service will be communicated to affected users.

14. Changes to These Terms

We may update these Terms periodically to reflect changes to our services, business practices, legal obligations or regulatory requirements.

The current version and date will be published on the Platform.

Where reasonably practicable, we will notify registered users of material changes affecting paid or ongoing services.

Continued use of the Platform after revised Terms take effect constitutes acceptance of those Terms to the extent permitted by applicable law.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Jamaica.

Subject to any mandatory rights or protections available under applicable law, disputes arising from or relating to these Terms or the Platform shall be subject to the jurisdiction of the courts of Jamaica.

Nothing in these Terms excludes, restricts or overrides any rights, protections or remedies that cannot lawfully be excluded or restricted.
