  1. Definition of Real Estate Business:
    • Engaging in the practice of real estate business means doing certain activities related to land for another person, and getting paid for it, either directly or indirectly.
    • These activities include:
      • Appraising, auctioning, selling, exchanging, buying, leasing, or renting land.
      • Advertising or telling people that you’re involved in activities like appraising, auctioning, buying, selling, exchanging, leasing, or renting land.
      • Managing land or doing other business related to managing land, either as a consultant or an agent.
      • Helping find sellers, buyers, landlords, or tenants for land.
      • Helping with finding potential buyers or renters, or with the negotiations for the sale, exchange, lease, or rental of land for someone else.
  2. Exceptions:
    • There are some situations where a person won’t be considered as engaging in real estate business, even if they’re doing some of the activities listed above. These exceptions include:
      • Acting as an attorney under a valid power of attorney to negotiate or execute contracts, transfers, or conveyances related to real estate.
      • Providing legal advice and services related to real estate as part of their profession as an attorney-at-law.
      • Acting as an officer of the court, an administrator, executor, receiver, trustee, or dealing with land they partly own.
      • Being a public officer carrying out official duties related to land.
      • Working as a manager of a condominium or co-operative apartment building or complex and handling the renting of individual units within that property.
  3. Regulations:
    • Regulations under this Act may add more types of people to the exceptions list and specify the extent to which certain professions or businesses are exempt from the real estate business definition.
