How to Remove a Caveat from a Land Title in Jamaica: A Step-by-Step Guide

To remove a caveat from a land title in Jamaica, the process is governed by the Registration of Titles Act. A caveat is a legal notice lodged with the Titles Office to prevent certain dealings with the property without notifying the caveator (the person who lodged it). Here’s how to go about removing it:


Ways to Remove a Caveat

If the person who lodged the caveat agrees to its removal:

  • The caveator must sign a Withdrawal of Caveat form.
  • This form must be witnessed by a Justice of the Peace or Notary Public.
  • Submit the form to the National Land Agency (NLA), Titles Office along with the appropriate fee.

2. By Application of the Registered Proprietor or Interested Party

If the caveator does not agree to remove the caveat:

  • The registered proprietor (or someone with an interest in the land) can apply to the Registrar of Titles to have the caveat removed.
  • This is done via a Notice Requiring Caveator to Show Cause.
  • The Registrar will then serve notice on the caveator, requiring them to justify the caveat within a specified time (usually 21 days).
  • If the caveator does not respond or fails to prove valid reason, the Registrar may order the removal of the caveat.

3. By Court Order

  • If there’s a dispute or complexity, either party can take the matter to the Supreme Court of Jamaica.
  • A judge may issue an order to remove or uphold the caveat, depending on the evidence and legal standing.

Documents and Fees

You will typically need:

  • The Certificate of Title (original or duplicate).
  • The Withdrawal of Caveat form (if applicable).
  • Identification documents.
  • Proof of authority (if acting on behalf of a party).
  • Statutory fees, payable to the Titles Office.

    How do you find out if a caveat is still on the land?

      The simplest way to check if one is still in place is to get a current Certificate of Title or a Caveat Card from eLandJamaica or the National Land Agency, where active caveats are clearly listed in the Encumbrances section. If the caveat is noted, it’s still active; if it’s absent or marked withdrawn, it’s no longer in force.
