Do You Need a Title to List a Property on the MLS in Jamaica?

Legally, you do not need a registered Certificate of Title to rent out your property as the owner, especially if you have proof of ownership through a legally binding agreement with the developer.

However, when using a licensed realtor and especially listing through the MLS (Multiple Listing System)most agencies require a title as a compliance and verification measure, not a legal one.

Realtors use the title to confirm ownership, legal status, and prevent disputes. They don’t want to list a property if they cannot verify you’re legally entitled to rent or sell it.


Your Situation

  • You bought the apartment from a developer in a new or incomplete scheme.
  • Splinter titles have not yet been issued (this is common in new developments).
  • You’re ready to rent it out, but the realtor refuses to list it without a title.

What You Can Do

If the splinter title is not ready yet, you have 2 realistic options:


1. Use a Private Platform

If your current realtor refuses:

  • Consider listing your property using classfied adverts

2. Ask the Developer for Help

Since you don’t yet have a title, ask the developer for assistance. You have two sub-options:

  • Ask the developer to issue a letter confirming your ownership and giving you the right to rent.
  • Request the developer to list the property for you through their real estate channels or preferred agent. Once a tenant is found, you can then:
    • Enter into a formal rental agreement directly with the tenant,
    • Or let the developer sign on your behalf, if allowed.

✔️ Is this legal?
Yes — as long as the developer still legally owns the title and gives written permission, this arrangement is not contrary to Jamaican property or rental laws. In fact, this is common practice in incomplete housing schemes.

3. Wait for the Splinter Title

If you’re committed to using the current realtor or listing on the MLS:

  • Wait until the developer completes the title registration process and hands over your splinter title.
  • Once you have it, you’ll be able to list with any licensed agent or platform.

Final Advice

You’re within your rights to rent your property without the title, provided you have a valid agreement and/or possession granted by the developer. However, many realtors won’t list it without a title — not because it’s illegal to do so, but because of their internal policies and risk management.
