Excess rent

In Jamaica, excess rent typically refers to the amount of rent paid by a tenant that exceeds the legally permissible or agreed-upon rent for a rental property. This can arise in various contexts: Overcharging by Landlords: If a landlord charges a tenant more than the rent stipulated in the lease agreement or exceeds the rent permissible under local regulations, this excess amount is considered excess rent. Regulated Rent: In some cases, there may be regulations or guidelines governing the maximum allowable rent for certain types of properties, such as those under rent control. If the rent charged is higher than these regulated limits, the excess is considered excess rent. Lease Disputes: During disputes between landlords and tenants, if it is determined that a tenant has paid more than what was contractually agreed upon or legally allowed, the excess amount may be identified and addressed as excess rent. To address issues related to excess rent, tenants may seek redress through the Rent Assessment Board or through legal channels to recover any overpaid amounts and ensure compliance with rental regulations.
