Bare license

A bare license is a form of permission that allows an individual to enter or use another person’s property for a specific purpose without creating any legal interest or right in the land. In Jamaica, this type of license is typically informal and does not involve a formal agreement or compensation, allowing access for a limited time or purpose, such as visiting or attending an event. The nature of a bare license is that it is revocable at the property owner’s discretion, meaning it can be terminated at any time. If the licensee remains on the property beyond the scope of the original permission, their presence can transition into that of a trespasser. Globally, bare licenses are used to manage short-term access needs while maintaining clear boundaries on property use, ensuring that such permissions are temporary and do not infringe on the property owner’s rights or lead to ongoing claims. The concept helps prevent unauthorized use by clarifying that any continued presence after the license’s scope is no longer valid can be considered trespassing.
